These General Booking Conditions (hereinafter General Conditions) shall govern the commercial relationship between TURISTICA ANTEL SL and the user or customer for the contract entered into through the forms that TURISTICA ANTEL SL makes available on its website www.beachclubgranfolies.com.

Booking through the websites of TURISTICA ANTEL SL will imply the express acceptance by the customer or user of the pages of these conditions, as well as the conditions of use established for the user’s navigation through the pages owned by TURISTICA ANTEL SL.

These conditions shall apply without prejudice to the application of the relevant legal regulations applicable in each case.

The General Terms and Conditions govern the remote booking relationship between TURISTICA ANTEL SL and the user or customer, in accordance with the legal provisions, in particular Law 7/1998 of 13 April on General Terms and Conditions, Law 3/2014, of 27 March, amending the revised text of the General Law for the Protection of Consumers and Users, Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights, General Data Protection Regulation (EU) 2016/679, Law 7/1996, of 15 January, on Retail Trade, and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.

TURISTICA ANTEL SL reserves the right to make any changes it deems appropriate to the General Terms and Conditions without prior notice. Such changes may be made through its websites, by any means admissible by law, and shall be binding for as long as they are published on the website and until they are validly modified by subsequent changes. However, TURISTICA ANTEL SL reserves the right to apply, in certain cases, Specific Contract Conditions in preference to these General Conditions when it deems it appropriate, announcing them in a timely manner.

All content on the website is in Spanish, English and German.

TURISTICA ANTEL SL informs that the booking procedure through its websites is detailed in the corresponding section for formalising the booking. Likewise, TURISTICA ANTEL SL informs that the user can access the terms of use available on the same website. By making a booking with TURISTICA ANTEL SL through its website, the user or customer expressly declares that they know, understand and accept these terms of use and the General Terms and Conditions. Similarly, the user declares that they are of legal age and have the legal capacity and authority necessary to access the TURISTICA ANTEL SL websites and make bookings through them. The user is responsible for treating the identity and password obtained during customer registration confidentially and responsibly, and may not transfer them to another person.

Once the booking has been made, the user will see the booking confirmation on screen and can print it as proof of the booking made.

The booking confirmation and proof of booking (printout made by the user) are not valid as an invoice.

HOW THE RESERVATION WORKS

Reservation offer and price reference

In compliance with current regulations and, in particular, Law 34/2002 on information society services and electronic commerce, TURISTICA ANTEL SL provides information on all possible bookings, their characteristics and prices in the corresponding section for making reservations. However, TURISTICA ANTEL SL reserves the right to withdraw, replace or change the offers made to its customers through its website by simply changing the content thereof. Thus, the products and/or services offered at any given time by the TURISTICA ANTEL SL website will be governed by the General Conditions in force in each case.

Likewise, the company shall have the right to cease offering access to the aforementioned products and/or services at any time without prior notice.

Price indication

Each possible booking offered will indicate its price in Euros and whether it includes VAT or any other applicable taxes. The prices shown on the screen will be those in force at any given time, except in the case of typographical errors. When the price differs for the reason stated above, TURISTICA ANTEL SL will notify the customer by email before proceeding to charge for the booking.

Availability

The availability of offers provided by TURISTICA ANTEL SL through its website may vary depending on customer demand. Although TURISTICA ANTEL SL updates its database regularly, the reservation requested by the customer may be full at that time. In this case, TURISTICA ANTEL SL will send an email to the customer informing them that the offer is unavailable.

The purpose of the Reservation service is to reserve a service in our restaurant. The restaurant does not guarantee a specific table location at the time of booking. The reservation will be automatically cancelled in the event of delays exceeding the 15-minute tolerance limit.

Any personalisation or special request must be explicitly communicated to the Restaurant and will be valid after express confirmation by our Restaurant reservations department, which may incur additional costs.

Payment methods

TURISTICA ANTEL SL requests credit card details from the person making the booking on its website in order to guarantee the validity of the booking. Please note that the establishment will charge your credit card when you make this booking. The establishment reserves the right to check the validity of the credit card before the customer’s arrival. The invoice for the booking will be delivered directly to the establishment or upon request at the time of booking.

The customer may pay for the service using any of the following methods. You must indicate your choice during the purchase process:

  • VISA or MASTERCARD credit card

All operations involving the transmission of personal or banking data are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) security technology. All information you send us is encrypted as it travels through the network.

Likewise, your credit card details are entered directly on the bank’s website, at the POS terminal (Point of Sale Terminal), and are not entered or recorded on any TURISTICA ANTEL SL server.

When paying with a VISA or MASTERCARD card, you will always be asked for the following information: the card number, the expiry date, and a validation code that matches the last three digits of the number printed in italics on the back of your VISA or MASTERCARD card, thus offering greater guarantees regarding the security of the transaction.

This payment method is only valid on the website.

When the amount of a purchase has been fraudulently or improperly charged using a payment card number, the cardholder may demand the immediate cancellation of the charge. In this case, the corresponding debit and credit entries in the accounts of the supplier and the cardholder will be made as soon as possible.

However, if the purchase was actually made by the cardholder and the refund request was not a result of exercising the right of withdrawal or termination, and therefore the cardholder improperly requested the cancellation of the corresponding charge, the cardholder will be liable to TURISTICA ANTEL SL for compensation for any damages caused as a result of said cancellation.

Cancellation Policy and Booking Guarantee

Non-refundable rate:

Cancellations cannot be made without penalty less than 72 hours in advance for sun loungers and 24 hours in advance for the restaurant.

Upon receiving the reservation, TURISTICA ANTEL SL will charge your card for the full amount. No refunds will be given in the event of cancellation, early departure or no-show. If payment is declined, TURISTICA ANTEL SL will cancel your reservation.

Exclusion of Users

TURISTICA ANTEL SL reserves the right to prevent the use of the Service, either temporarily or permanently, to any User who violates any of the rules set forth in these Terms of Use, the law, or morality. At its discretion, TURISTICA ANTEL SL may also exclude Users and even cease to provide the Service in whole or in part when it deems it appropriate to improve the operation of the Service and/or for the benefit of other users of the Service, notifying the affected Users in advance.

Withdrawal

According to Article 103 of Law 3/2014, of 27 March, amending the revised text of the General Law for the Protection of Consumers and Users, the supply of services or goods made to the consumer’s specifications or clearly personalised, or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly, are exempt from withdrawal.

In accordance with applicable and current data protection regulations, TURISTICA ANTEL SL informs users that the personal data collected during the registration and/or booking process will be incorporated into the processing system owned by TURISTICA ANTEL SL, for the purpose of processing these actions by the user and managing subsequent actions derived from them.

Your data will be kept for the period strictly necessary to fulfil the aforementioned purposes, unless there is a legal obligation to retain it.

We inform you that the legal basis for the processing of your data is the proper execution of the contract between the parties and consent.

Although TURISTICA ANTEL SL updates its stock periodically, the product requested by the customer may be out of stock at that time. In the event of non-fulfilment due to unavailability, TURISTICA ANTEL SL will notify the customer by email as soon as it becomes aware of this situation. The period of this communication shall in no case exceed a maximum of 30 days. Right of withdrawal, returns and complaints

Right of withdrawal

The buyer will have a period of fourteen calendar days to withdraw, starting from the day the customer receives the product, without penalty and without giving any reason.

The return

The customer must return or deliver the product directly to TURISTICA ANTEL SL, at the address CENTRO COMERCIAL SES VELES 22, 07157 PORT D’ANDRATX (ILLES BALEARS), without undue delay, and in any case within a maximum period of fourteen calendar days from the date on which the right to withdraw from the contract is formalised. The deadline shall be deemed to have been met if the customer returns the product before the end of the deadline.

The customer shall bear the costs of returning the product.

Refund of payment

Refunds of amounts received from the customer will be made using the same payment methods used by the customer, unless otherwise specified.

TURISTICA ANTEL SL will refund the amounts paid by the customer within 14 calendar days from the date of receipt of the right of withdrawal.

In the event that the product is not in good condition and the causes attributable to this are not the fault of the customer, the customer shall be entitled to return the product, informing TURISTICA ANTEL SL of the reason for the return through any of the means provided in these terms and conditions, and at no cost to the customer. This return due to a defect or poor condition of the product shall not be considered a right of withdrawal.

TURISTICA ANTEL SL undertakes to bear the cost of the return and to replace the product with a new one in accordance with the conditions accepted at the time of sale.
